C\u00d3DIGO FISCAL DE LA FEDERACI\u00d3N Y A LA LEY ORG\u00c1NICA DEL TRIBUNAL FEDERAL DE JUSTICIA ADMINISTRATIVA."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">El Congreso General de los Estados Unidos Mexicanos aprob\u00f3, y la presidenta Claudia Sheinbaum Pardo promulg\u00f3, un Decreto que reforma y adiciona diversas disposiciones de la Ley de Amparo, el C\u00f3digo Fiscal de la Federaci\u00f3n y la Ley Org\u00e1nica del Tribunal Federal de Justicia Administrativa, con el prop\u00f3sito de modernizar los procedimientos judiciales, incorporar herramientas electr\u00f3nicas y fortalecer la justicia digital en M\u00e9xico.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">EN LA LEY DE AMPARO, SE REFORMAN LOS ART\u00cdCULOS 3\u00b0, 7\u00b0, 25, 26, 28, 30, 60, 111, 124, 128, 137, 138, 146, 148, 166, 168, 181, 186, 260, 262 Y 271, Y SE ADICIONAN DISPOSICIONES EN LOS ART\u00cdCULOS 5\u00b0, 27, 28, 59, 60, 82, 107, 111, 115, 121, 128, 129, 135, 168 Y 192, ENTRE OTROS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Los principales cambios son los siguientes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Se establece que las promociones podr\u00e1n presentarse en formato electr\u00f3nico o impreso, siendo opcional el uso de medios digitales, garantizando que ninguna persona sea excluida del procedimiento por no utilizar herramientas tecnol\u00f3gicas (art. 3\u00b0).<\/li>\n\n\n\n<li>Se reconoce formalmente la Firma Electr\u00f3nica como medio de ingreso al sistema electr\u00f3nico del Poder Judicial de la Federaci\u00f3n, con validez jur\u00eddica equivalente a la firma aut\u00f3grafa, y como herramienta para presentar escritos, recibir notificaciones y consultar resoluciones (art. 3\u00b0).<\/li>\n\n\n\n<li>Las partes, sus representantes y autoridades deber\u00e1n registrarse en el Portal de Servicios en L\u00ednea del Poder Judicial de la Federaci\u00f3n, o bien, actuar a trav\u00e9s de Convenios de Interconexi\u00f3n con el \u00d3rgano de Administraci\u00f3n Judicial o la Suprema Corte de Justicia de la Naci\u00f3n (arts. 3\u00b0, 25, 26 y 30).<\/li>\n\n\n\n<li>Los titulares de los \u00f3rganos jurisdiccionales ser\u00e1n responsables de la digitalizaci\u00f3n y resguardo de los expedientes f\u00edsicos y electr\u00f3nicos, asegurando su integridad y consulta por las partes (art. 3\u00b0).<\/li>\n\n\n\n<li>El \u00d3rgano de Administraci\u00f3n Judicial emitir\u00e1 los acuerdos generales para regular el uso de la Firma Electr\u00f3nica y la integraci\u00f3n de los expedientes, tanto en formato f\u00edsico como digital (arts. 3\u00b0 y 28).<\/li>\n\n\n\n<li>Se establece que las copias certificadas para el juicio de amparo no causar\u00e1n contribuci\u00f3n (art. 3\u00b0).<\/li>\n\n\n\n<li>Se adicionan nuevas fracciones al art\u00edculo 129, para precisar supuestos en los que puede negarse la suspensi\u00f3n, especialmente cuando afecte intereses sociales, financieros o de seguridad nacional.<\/li>\n\n\n\n<li>Se precisan disposiciones sobre notificaciones electr\u00f3nicas, plazos procesales, audiencias y sanciones a servidores p\u00fablicos que incumplan con sus obligaciones (arts. 26, 27, 60, 82, 115, 124, 146 y 260).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">En el C\u00f3digo Fiscal de la Federaci\u00f3n, se adicionan las fracciones X, XI y XII al art\u00edculo 124, estableciendo nuevos supuestos de improcedencia del recurso de revocaci\u00f3n, entre ellos, cuando se trate de actos relacionados con cr\u00e9ditos fiscales firmes o prescripci\u00f3n de dichos cr\u00e9ditos.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En la Ley Org\u00e1nica del Tribunal Federal de Justicia Administrativa, se reforma la fracci\u00f3n II del art\u00edculo 3\u00b0, precisando que el Tribunal no ser\u00e1 competente para conocer de resoluciones relacionadas con cr\u00e9ditos fiscales determinados en resoluciones firmes o prescritas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El \u00d3rgano de Administraci\u00f3n Judicial contar\u00e1 con 360 d\u00edas naturales para adecuar el sistema electr\u00f3nico del Poder Judicial y 180 d\u00edas adicionales para emitir los acuerdos generales sobre la integraci\u00f3n de los expedientes electr\u00f3nicos y f\u00edsicos. Asimismo, las autoridades federales, estatales y municipales deber\u00e1n registrarse en el sistema dentro de los 180 d\u00edas naturales siguientes a la publicaci\u00f3n del aviso correspondiente.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En conclusi\u00f3n, estas reformas representan un avance significativo hacia la justicia digital en M\u00e9xico, al garantizar la validez legal de los medios electr\u00f3nicos, la seguridad jur\u00eddica de las actuaciones en l\u00ednea y la eficiencia en los procedimientos judiciales, fiscales y administrativos, sin restringir el acceso de las personas que prefieran utilizar medios tradicionales.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La presente resoluci\u00f3n entrar\u00e1 en vigor el d\u00eda de su publicaci\u00f3n en el DOF: Debido a la naturaleza informativa del comunicado, los invitamos a consultar la publicaci\u00f3n oficial en el <a
